We recently debuted our new Weldcraft 300 Cuddy King OS at the 2020 Chicago Boat Show. She WOWED attendees with her impressive size as well as the many custom features included in our "Great Lakes Edition" package. We are fortunate to have very talented people who can do custom welding, custom electrical systems, electronics, and custom fishing gear. Because of this we created this package specifically for fishing in the Great Lakes. Take a walk-through with Bruce from WeldCraft as he discusses this new 300 Cuddy King OS aluminum fishing monster and her great features to make die-hard fishermen comfortable in any type of weather.

2019 Ranger Tugs Rendezvous

RYS's own Mark Derenne returned from the Ranger Tug Rendezvous up in Charlevoix, Michigan. What a great time! Ranger Tugs and their happy owners ventured in from all over the Great Lakes for some days of fun and fraternity. The harbor at Charlevoix is delightful spot, adjacent to a lovely downtown park and entertainment pavilion, main street shopping, many restaurants and enjoyable amenities. Mark stayed on a beautiful Ranger Tug R-29 that he brought to the event.

How a national boat dealer in West Michigan landed in bankruptcy

For the past two months, a major nationwide boat dealer based in downtown Grand Rapids has been embroiled in three separate lawsuits between a supplier and two banks, with fraud accusations and hundreds of millions of dollars at stake.

On May 20, the financial maelstrom engulfing Tommy’s Boats LLC reached a new phase when the company filed for bankruptcy protection to hopefully find a buyer and pay back creditors at “the highest possible value.”

Company president and owner Matthew Borisch on June 4 offered his version of the events in a 21-page declaration. He blames Tommy’s Boats’ primary supplier for leaving the company with no choice but to file for bankruptcy, having intentionally “bled (Tommy’s) dry” through an elaborate inventory oversupply scheme.

Meanwhile, Tommy’s Boats’ two largest creditors have targeted the company in separate lawsuits.

Here’s a breakdown of how the company got here and what’s at stake:

What is Tommy’s Boats?

Founded in 1981 in Denver, Colo., Tommy’s Boats was later acquired by the Borisch family and now lists 15 dealerships in eight states. In late 2022, the company opened a new 16,000-square-foot dealership in Comstock Park just north of Grand Rapids, and bills itself as one of the largest pontoon dealers in North America. 

Matthew Borisch serves as president and owner of Tommy’s Boats. Simplified Facilities LLC, a holding company tied to Borisch, acquired the former Peninsular Club building in downtown Grand Rapids in March 2023 from RDV Corp. for Tommy’s corporate headquarters.

Borisch is the son of Jonathan Borisch, who previously had a career in manufacturing and later owned McKay Tower in downtown Grand Rapids before selling it to tribally owned Gun Lake Investments and Waséyabek Development Co. in early 2020. Matthew Borisch also serves as the CEO of Simplified Investments, whose portfolio includes Tommy’s Boats, Gen3 Defense and Aerospace engineering firm and Gen3 Interconnect, a third-generation wire harness manufacturer. 

Nearly a decade ago, the Borisch family was reportedly credited for helping to turn around Walloon Lake, a former northern Michigan resort community, into a tourist destination with restaurants, retail and lodging.

Who are the other players?

Tommy’s Boats has long been the largest national dealer for Loudon, Tenn.-based Malibu Boats Inc. in the recreational power boat space, accounting for roughly one-third of Malibu’s power boat sales. According to court filings, dealer agreements in place with Malibu accounted for more than 80% of the boats Tommy’s Boats sold in 2022-2023.

Malibu employs more than 700 people who build boats at locations in Tennessee, California and Australia, according to its website.

Tommy’s Boats’ largest creditor is Buffalo, N.Y.-based M&T Bank, which was the first to file suit against the Grand Rapids-based boat dealer, seeking a court-ordered receiver over the company’s assets.

Grand Rapids-based Mercantile Bank is Tommy’s Boats’ second-largest creditor and filed suit last month seeking to foreclose on and seize property the Borisch family owns Up North.

How did lawsuits start piling up?

April 1: M&T Bank sought a court-appointed receiver because Tommy’s Boats allegedly defaulted on loan agreements executed in May 2023 and hadn’t made sufficient repayment by the time of the bank’s April 1 suit. The motion also alleges that Tommy’s Boats sold at least $14 million in inventory out of trust, which means selling items bought with a loan and not remitting the agreed-upon share of proceeds to the lender. April 10: Tommy’s Boats sues Malibu, saying the company’s actions forced it into default with M&T. In his June 4 declaration, Borisch alleges Malibu Boats’ former CEO Jack Springer, whose employment has since been terminated by Malibu, hatched an intentional and fraudulent scheme to increase Tommy’s floor plan financing capacity and oversaturate the dealer’s inventory with high-priced, hard-to-sell boats. Borisch accuses Malibu of doing so to “artificially inflate Malibu sales and market share” amid “historic lows in retail luxury power boat demand and sales activity.” Malibu denies the accusations and says Tommy’s Boats ordered the inventory. April 22: Kent County Circuit Judge T.J. Ackerman appointed Thomas Beane , president of Wilmington, Del.-based Beane Associates, as the receiver over Tommy’s Boats. The action gave Beane authority to take “immediate possession and full control” of the dealer’s assets and income with the ultimate goal of paying off receivership fees, bank debts and court fees. April 24: Mercantile Bank filed suit against Borisch, a couple of his holding companies and several family members, seeking to foreclose on and seize property that the family owns in Boyne City and pledged as collateral to guarantee a commercial loan of more than $9.5 million for Tommy’s Boats locations in California, Nevada and Arizona, according to Kent County Circuit Court filings. 

May 20: Tommy’s Boats files for bankruptcy protection in the U.S. Bankruptcy Court for the Northern District of Texas so it can find a buyer and pay back creditors at “the highest possible value.” Court filings indicate Tommy’s Boats has assets of $1 million to $10 million and liabilities of $100 million to $500 million. How much money is at stake?

Hundreds of millions of dollars.

M&T Bank claims that the collateral on Tommy’s Boats dealership lots is worth approximately $85 million. Selling off the collateral would go toward paying more than $115 million in debt principal and more than $2.2 million in interest that Tommy’s Boats allegedly owes to the bank, plus attorney’s fees and other expenses.

M&T Bank discovered an alleged contract violation when an auditor visited the dealership lots in February 2024 and learned that Tommy’s Boats was selling boats meant to be reserved as collateral, then keeping them on the dealership lots in storage and failing to report the sales to the bank or to adjust the inventory log accordingly. 

About 17 boats are unaccounted for, according to M&T Bank.

M&T also alleges that Tommy’s Boats owes the various states where it has dealerships more than $3.2 million in back sales taxes.

According to Tommy’s Boats’ lawsuit, Malibu beginning in late 2022 demanded that Tommy’s increase its floor plan credit facility with M&T Bank from $50 million to $160 million to make room for 25 weeks of inventory at the turn of the next model year. Malibu has denied the claims.

In its bankruptcy filing, Tommy’s Boats listed the 30 largest unsecured claims totaling nearly $123.6 million. M&T Bank is listed as the company’s largest creditor, with a total claim of more than $105 million, followed by Mercantile Bank with a $4.7 million claim. The filing also lists approximately $5 million in unpaid sales taxes in several states.

Meanwhile, a Denver-area couple say they are out $7,000 for a custom boat that Tommy’s Boats never delivered as the company’s ongoing financial and legal battles landed it in receivership.

What happens next?

The litigation with Malibu remains ongoing. A Kent County circuit judge issued a stay in the receivership case on May 22 while Tommy’s pursued the Chapter 11 case.

Monica Blacker, chief restructuring officer for Tommy’s Boats, said in court filings that the company filed the bankruptcy case “to minimize the disruption to and adverse effects the receivership has had on the Debtors’ business operations and to maximize the value of the Debtors’ business, assets, and estates so the Debtors can sell substantially all of their assets for the highest possible value through these Cases.”

So far, the bankruptcy court has allowed Tommy’s to reopen its service and repair departments and continue operating as usual. Tommy’s Boats officials said over the Memorial Day weekend, the company also finalized the sales of 10 boats and delivered seven vessels to customers who had already made deposits.

Meanwhile, the bankruptcy court rejected Tommy’s Boats’ request for an order stopping Malibu from setting up “replacement dealers” in Tommy’s Boats’ “exclusive territories” negotiated under previous dealership agreements. Tommy’s Boats also alleged in the filing that Malibu and replacement dealers “poached” Tommy’s Boats employees. Bankruptcy Judge Edward Morris denied the request on Sunday.

The court has set a June 27 hearing to consider several emergency motions Tommy’s Boats filed to help it meet ongoing financial obligations during bankruptcy proceedings.

Alleged ‘super drunk’ driver in boat club crash had BAC level more than twice the legal limit

MONROE COUNTY, MI -- Several new details have come to light involving the woman accused of allegedly killing two children and injuring several more by driving into the Swan Creek Boat Club in April. During a preliminary examination Thursday prosecutors presented several new pieces of information regarding Marshella Chidester’s actions prior to the crash and her interactions with police following.

Among the newly released pieces of information are details regarding:

• Chidester’s blood-alcohol-content level being more than double the legal limit.
• Security footage showing Chidester hitting a parked car while backing out of her driveway.
• Chidester telling police that she’d drunk wine 30 minutes prior to the crash.
• Chidester telling an officer “I wouldn’t want to drive,” when asked if she thought she was OK to drive.

Chidester, 66, is charged with multiple felonies in connection with the crash, including two counts of second-degree murder for the deaths of 8-year-old Alanah Phillips and 4-year-old Zayn Phillips.

A child’s birthday party was taking place inside the boat club when Chidester drove her SUV through a wall, hitting multiple people before ultimately stopping approximately 25 feet inside the facility.

Blood test results read in court showed Chidester had a blood-alcohol-content level at the time of the crash was more than double the legal limit. The blood test was conducted shortly after the and revealed Chidester’s BAC was .18, which is higher than Michigan’s legal limit of .08. In Michigan, anyone with a BAC over .17 is considered “super drunk.”

Chidester and her attorney Bill Colovos claim that she suffered a seizure prior to the crash , which caused her to drive into the building near her house. During an exam in April, Colovos argued that his client only had one glass of wine at lunch prior to the crash and that a receipt from a nearby tavern proved she only ordered one glass.

However, body camera and security footage showed in court Thursday, along with testimony from responding officers casts doubt on those claims. Footage taken from a security camera across the street from Chidester’s home shows her backing out of her driveway and hitting a vehicle parked next door before speeding away. Soon after, Chidester would drive into the boat club.

Body camera footage taken by responding officers shows Chidester telling an officer that she had been drinking wine earlier in the day and that her last drink was about 30 minutes prior to the crash. Other body cam video shows Chidester speaking with a deputy about what happened prior to the crash.

“I pulled into the parking lot and I thought I was driving up to the boat club and evidently I was driving right into the building,” Chidester told the deputy.

When the deputy asked what happened when she got to the parking lot, Chidester replied “I don’t remember.” When the deputy asked if there is a reason why she doesn’t remember, Chidester mentioned her seizures but clarified that she had been cleared to drive. Chidester also told police that she had a seizure the month prior to the crash and had been hospitalized for it.

Later in the same body cam video, the deputy had the following exchange with Chidester:

Deputy : On a scale of 0-10, zero being like you’re stone-cold sober, you can drive perfectly, 10 being you’re passed out drunk, where do you think you’re at right now?

Chidester : A seven.

Deputy : Do you think you’re OK to drive?

Chidester : I wouldn’t want to drive.

Deputy : You wouldn’t let you drive?

Chidster : No.

During the morning proceedings, Monroe County Sheriff’s Deputy Steven Schmidt was called to the stand and testified that he conducted multiple field sobriety tests on Chidester. Schmidt said Chidester was unable to complete multiple tests, but was able to recite the alphabet.

Schmidt further testified that he could smell intoxicants on Chidester’s person and that she was unable to maintain her balance, while also exhibiting bloodshot and watery eyes.

Thursday’s preliminary examination is being held to determine if there is enough evidence for the case to be bound over to circuit court. The exam was previously delayed by two months as Colovos argued that he needed more time to examine the discovery in the case.

Along with the murder charges, Chidester has been charged with two counts of operating while intoxicated causing death and four counts of operating while intoxicated causing serious injury.

Chidester is currently free on a $1.5 million bond she posted in April. As part of the conditions of her bond, she is required to wear a GPS tether and must refrain from using alcohol or any illegal controlled substances.

A Michigan woman has been ordered to stand trial in a crash that killed two siblings and injured several other people who were at a boat club to celebrate a child’s birthday.

Marshella Chidester, 66, was bound over Thursday to Monroe County Circuit Court on two counts of second-degree murder and other charges in the April 20 crash at the Swan Boat Club in Berlin Township, about 30 miles (48 kilometers) south of Detroit.

Authorities have said Chidester was under the influence of alcohol at the time of the crash. A deputy testified Thursday during Chidester’s preliminary examination in Monroe County District Court that a blood test at a hospital after the crash revealed her blood alcohol content was 0.18. The legal limit in Michigan for operating a vehicle is 0.08.

Deputies said Chidester told them she was headed to a birthday party at the boat club. She told one deputy that she had “passed out” while driving.

Surveillance video played Thursday showed a SUV barreling along an unpaved road leading to the boat club, then crashing into the building. After authorities arrived, police bodycam video showed the SUV stopped against a counter or wall as several injured people were being treated by first responders.

Monroe County sheriff’s deputy Steven Schmidt testified that the scene was chaotic. “There were injured people everywhere,” he said, adding that a small child who appeared not to be breathing was on the ground.

Killed were 8-year-old Alanah Phillips and her 4-year-old brother, Zayn Phillips. Their mother, Mariah Dodds, and another sibling were among the injured.

Dodds testified that the party was for the 3-year-old child of a friend.

Defense attorney Bill Colovos argued against the second-degree murder charges, saying there was no testimony that Chidester operated her vehicle with intent to cause the deaths.

He said during Chidester’s arraignment in April that she only had a glass of wine and a bowl of chili four hours before the crash, and that she has suffered since November with “epileptic-type seizures in her legs.”

Prosecutor Jeff Yorkey argued at Chidester’s arraignment that she has had substance abuse issues that were corroborated by her friends and family. Yorkey also said there was no indication that Chidester suffered a seizure before the crash.

Home surveillance video recorded just prior to the crash and played in court Thursday showed Chidester holding a railing and going step-by-step from her porch, then walking slowly to her SUV, which was parked next to a garage. As she backed out from the driveway, the SUV sped in reverse around the opposite side of the garage and slammed into a neighbor’s parked vehicle. The SUV then accelerated forward, past the garage, driveway and down the road.

Detective Sgt. Jeff Hooper testified that Chidester’s home is about 500 feet from the boat club near Lake Erie.

Chidester’s circuit court arraignment is scheduled for July 12.
