Also noteworthy are Bay Marina, Dubai’s first dedicated superyacht marina, with berths for vessels up to 160 meters; Palm View Marina, located on the Dubai Harbour seafront, which boasts a lively shoreside walkway; and Nakheel Marinas on Palm Jumeirah, which welcomes a range of sailing vessels with 261 berths in two marinas plus luxury yacht services.

Dh431m project to improve access to Dubai Harbour

T ransport authorities have awarded a Dh431 million contract to improve access to Dubai Harbour and cement its status as a “unique seafront destination”.

Dubai's Roads and Transport Authority said on Sunday the funding would be used to construct a 1.5km, two-lane bridge serving 6,000 vehicles an hour to connect Sheikh Zayed Road to the waterfront district.

It aims to cut average travel times from 12 minutes to three as part of a partnership with harbour owner, Shamal Holding.

The road infrastructure scheme was announced in February as part of a wider Dubai strategy to upgrade the emirate's transport networks to keep pace with urban expansion and population growth.

The bridge will extend from the fifth intersection on Sheikh Zayed Road, near the American University in Dubai, to Dubai Harbour Street.

It passes by the intersection of Al Naseem Street with Al Falak Street and crosses over the intersection of King Salman bin Abdulaziz Al Saud Street up to Dubai Harbour.

“The project provides a direct entry/exit for Dubai Harbour to ease the movement of visitors and residents,” said Mattar Al Tayer, director general of the RTA.

““The project also includes surface improvements at four intersections along the bridge: the fifth intersection on Sheikh Zayed Road, the intersection of Al Falak Street with Al Naseem Street, the intersection of King Salman bin Abdulaziz Al Saud Street with Al Naseem Street, and Dubai Harbour Street. When completed, the project will improve the flow of traffic and reduce the travel time from 12 minutes to 3 minutes.”

The RTA did not say when work will begin on the scheme or when it is likely to be completed.

Abdulla Binhabtoor, chief executive at Shamal Holding, said the move was in line with efforts to make the harbour a better place to visit and live.

“As the owning company and curator of Dubai Harbour, Shamal Holding is committed to building extraordinary communities and enhanced experiences, making Dubai Harbour a unique seafront destination and an extraordinary seafront residential community,” he said.

“We have commenced a range of enhancements and investments as part of our plans to offer the best integrated community in terms of quality of life and the well-being of residents and visitors.”

Dubai Harbour is home to two cruise terminals spanning 120,000 square metres, a vast marina, residential developments and leisure facilities.

The harbour – located between Palm Jumeirah and Bluewaters – became the home for the Dubai International Boat Show in 2022.

A 1.5-km development project is also under way, including a residential complex with 24 towers and about 7,500 apartments.

Superyachts aren’t just for the super-rich: Hundreds of scientists have used them for ocean research

For almost two years, Robert Brewin collected data from the bow of a superyacht as it sailed pristine waters from the Caribbean Sea to the Antarctic Ocean. 

The  Archimedes , a 222-foot (68-meter) “adventure” yacht then owned by the late hedge funder James Simons, boasts a gym, a jacuzzi and an elevator. But between 2018 and 2020, Brewin was concerned only with the boat’s Sea-Bird Scientific Solar Tracking Aiming System, installed to measure light reflecting off of the water. A senior lecturer at the UK’s University of Exeter, Brewin and his colleagues were analyzing microplankton — microscopic organisms at the base of the marine food chain — by studying the ocean’s color. The Sea-Bird’s readouts helped them verify satellite imagery. 

Brewin’s was not your typical superyacht itinerary, but he is one of hundreds of scientists to have used an adventure yacht — also known as expedition or explorer yachts — to conduct research on the ocean. In a  paper  published in January, Brewin and his co-authors touted the potential of “harnessing superyachts” for science, concluding that “reaching out to wealthy citizen scientists may help fill [research capability] gaps.” 

It’s a view shared — and being pushed — by the Yacht Club of Monaco and the Explorers Club, a New York City-based organization focused on exploration and science (of which, full disclosure, I am a member). In March, the groups co-hosted an environmental symposium that included an  awards ceremony  for yacht owners who “stand out for their commitment to protecting the marine environment.” The  Archimedes  won a “Science & Discovery” award. 

“If a yacht is operating 365 days a year, rather than having it sit idle it’d be much better for it to contribute a positive return through science and conservation,” says Rob McCallum, an Explorers Club fellow and founder of US-based EYOS Expeditions, which runs adventure yacht voyages. 

EYOS charters yachts from private owners for its excursions, and is a founding member of Yachts for Science, a four-year-old organization that matches privately owned yachts with scientists who need time at sea. (Other members include yacht builder Arksen, media firm BOAT International, and nonprofits Nekton Foundation and Ocean Family Foundation.) Yachts for Science will enable about $1 million worth of donated yacht time this year, McCallum says, a figure he expects to hit $15 million by 2029. 

“There’s a personal satisfaction that we are contributing to something that is bigger than us,” says Tom Peterson, who co-owns an insurance underwriting company in California and has what he jokingly refers to as a “mini superyacht.” Every year for the past decade, Peterson has donated about 15 to 20 days of time and fuel on the 24-meter  Valkyrie  to scientists, who he takes out himself as a licensed captain and former scuba dive operator. He often works with the Shark Lab at California State University Long Beach, and allows researchers to stay aboard for days at a time instead of having to constantly make the 1.5-hour trip to and from shore. 

To link up with scientists, Peterson works with the International SeaKeepers Society, a Florida-based nonprofit that engages the yachting community to support ocean conservation and research. “The more we understand things about the ocean in general, the better we all are in the long run,” he says. 

When “superyacht” and “the environment” appear in the same sentence, it’s usually in a different context. In 2019,  one study estimated  that a single 71-meter superyacht has the same annual carbon footprint as about 200 cars. In 2021, another  paper  found that superyachts were the single greatest contributor to the carbon footprint of 20 of the world’s most prominent billionaires, accounting for 64% of their combined emissions.

“If you really want to respect the environment, you can just go surf,” says Grégory Salle, a senior researcher at the French National Centre for Scientific Research and author of the book  Superyachts: Luxury, Tranquility and Ecocide . Salle is open to the idea that superyachts could be used to advance scientific research, but says it’s contradictory for anyone to buy a superyacht and claim to be truly concerned about the environment.

McCallum says people who own adventure yachts tend to be younger than your standard superyacht owner, and have a particular interest in remote and pristine places. “They’re not the sort of people that are content to just hang out in the Mediterranean or the Caribbean,” he says. “Antarctica, the Arctic, the remote Indian Ocean, the remote Pacific Ocean, the Subantarctic islands… that’s where you’re going to find us delivering our services.”

Explorer yachts aren’t the only way scientists can reach those destinations, but demand for dedicated research vessels does outstrip available supply. The US National Oceanic and Atmospheric Administration (NOAA), arguably the world’s greatest collector of oceanographic data, has a fleet of  15 research and survey vessels  for the use of its scientists. Academic researchers can also apply to use the fleet, often at a subsidized rate. But scientists request roughly 15,000 to 20,000 days of boat time every year. In 2019, NOAA was able to fill just 2,300 of them, according to an internal study.

That gap is particularly problematic as the planet warms. Oceans provide services that scientists call “ existentially important ,” producing more than  half of the oxygen we breathe  and serving as the world’s  largest carbon sink . They also absorb  30% of our carbon emissions  and  90% of the excess heat generated by them .

G. Mark Miller, a retired NOAA Corps officer who was in charge of several of the agency’s research vessels, has a different solution in mind when it comes to bolstering ocean research: smaller boats, fit for purpose. Superyachts can cost north of $500 million, he says; “why don’t we build a hundred $5 million vessels and flood the ocean science community?” 

After leaving NOAA, Miller in 2021 launched Virginia-based Greenwater Marine Sciences Offshore with a vision of building a global fleet of research vessels and offering their use at affordable prices. He says hiring a NOAA boat can cost scientists between $20,000 and $100,000 per day. GMSO plans to charge less than $10,000 a day for most missions. The company says it’s close to acquiring its first three vessels.

Miller hopes his business model will help scientists conduct the work they need to — particularly in under-served regions like the Asia-Pacific — without worrying about getting a luxury yacht covered in “muddy worms, plankton goo, dead fish [and] whale snot.” He describes yacht owners donating boat time to scientists as “better than nothing,” and says it can help get regular people interested in science and exploration. 

Christopher Walsh, captain of the  Archimedes , says he and his crew love taking part in science initiatives, especially when there’s an educational component. “I get a real thrill when we can stream to the classrooms — you can’t imagine the enthusiasm the kids display,” Walsh says. “That gives me a lot of hope for the future.”

Justices Limit Power of Federal Agencies, Imperiling an Array of Regulations

A foundational 1984 decision had required courts to defer to agencies’ reasonable interpretations of ambiguous statutes, underpinning regulations on health care, safety and the environment.

The Supreme Court on Friday reduced the power of executive agencies by sweeping aside a longstanding legal precedent, endangering countless regulations and transferring power from the executive branch to Congress and the courts.

The precedent, Chevron v. Natural Resources Defense Council , one of the most cited in American law, requires courts to defer to agencies’ reasonable interpretations of ambiguous statutes. There have been 70 Supreme Court decisions relying on Chevron, along with 17,000 in the lower courts.

The decision is all but certain to prompt challenges to the actions of an array of federal agencies, including those regulating the environment, health care and consumer safety.

The vote was 6 to 3, dividing along ideological lines.

“Chevron is overruled,” Chief Justice John G. Roberts Jr. wrote for the majority. “Courts must exercise their independent judgment in deciding whether an agency has acted within its statutory authority.”

In dissent, Justice Elena Kagan said the ruling amounted to a judicial power grab. “A rule of judicial humility,” she wrote, “gives way to a rule of judicial hubris.”

Justice Kagan summarized her dissent from the bench, a rare move and a sign of profound disagreement. “Courts, in particular this court, will now play a commanding role” in setting national policy, she said.

The court has overturned major precedents in each of the last three terms: on abortion in 2022, on affirmative action in 2023 and now on the power of administrative agencies.

Chief Justice Roberts said Chevron must be overruled because it “has proved to be fundamentally misguided” and is unworkable. “All that remains of Chevron,” he wrote, “is a decaying husk with bold pretensions.”

Justice Kagan responded that Chevron was, until Friday, vibrant and valuable. “It has become part of the warp and woof of modern government,” she wrote, “supporting regulatory efforts of all kinds — to name a few, keeping air and water clean, food and drugs safe, and financial markets honest.”

The decision was the latest in a sustained series of legal attacks on what its critics call the administrative state. On Thursday, for instance, the court rejected the Securities and Exchange Commission’s use of administrative tribunals to combat securities fraud.

That decision put at risk the ability of other regulatory agencies to bring enforcement actions in such tribunals. It was, Justice Kagan wrote on Friday, “yet another example of the court’s resolve to roll back agency authority, despite congressional direction to the contrary.”

The chief justice wrote that the retroactive impact of Friday’s decision will be limited, saying that regulations upheld by courts under Chevron were not subject to immediate challenge for that reason alone.

Justice Kagan, quoting an earlier opinion, disagreed. “The majority’s decision today will cause a massive shock to the legal system, ‘casting doubt on many settled constructions’ of statutes and threatening the interests of many parties who have relied on them for years.”

For one thing, she wrote, “some agency interpretations never challenged under Chevron now will be.”

For another, she discounted the chief justice’s assurance that earlier decisions will generally not be subject to challenge. “The majority is sanguine; I am not so much,” she wrote. “Courts motivated to overrule an old Chevron-based decision can always come up with something to label a ‘special justification’” to overcome the generally required respect for precedent.

In general, she wrote, “it is impossible to pretend that today’s decision is a one-off, in either its treatment of agencies or its treatment of precedent.”

Justices Sonia Sotomayor and Ketanji Brown Jackson joined Justice Kagan’s dissent.

The conservative legal movement and business groups have long objected to the Chevron ruling, partly based on a general hostility to government regulation and partly based on the belief, grounded in the separation of powers, that agencies should have only the power that Congress has explicitly given them.

Supporters of the doctrine say it allows specialized agencies to fill gaps in ambiguous statutes to establish uniform rules in their areas of expertise, a practice they say was contemplated by Congress.

Justice Kagan echoed that view. “Some interpretive issues arising in the regulatory context involve scientific or technical subject matter,” she wrote. “Agencies have expertise in those areas; courts do not. Some demand a detailed understanding of complex and interdependent regulatory programs. Agencies know those programs inside-out; again, courts do not.”

Its opponents counter that it is the role of courts, not executive branch officials, to determine the meanings of statutes. They also say agencies’ interpretations can change with new administrations and put a thumb on the scale in favor of the government in lawsuits even when it is a party to the case.

Chief Justice Roberts said the basic point was that “agencies have no special competence in resolving statutory ambiguities.”

“Courts do,” he wrote. Justices Clarence Thomas, Samuel A. Alito Jr., Neil M. Gorsuch, Brett M. Kavanaugh and Amy Coney Barrett joined the majority opinion.

In overruling Chevron, the court returned the nation to the world that existed before it was decided in 1984. But the two sides were in sharp disagreement over what that world looked like and how courts had treated the work of the many administrative agencies created during the New Deal.

Chief Justice Roberts wrote that the Supreme Court had had the last word.

“As new agencies with new powers proliferated,” he wrote, “the court continued to adhere to the traditional understanding that questions of law were for courts to decide, exercising independent judgment.”

Justice Kagan took the opposite view. As New Deal programs came into their own, she wrote, “courts became ever more deferential to agencies.”

The court decided two almost identical cases, Loper Bright Enterprises v. Raimondo, No. 22-451, and Relentless v. Department of Commerce, No. 22-1219. Justice Jackson was recused from the first case because she had participated in it as a federal appeals court judge.

Both cases involved a 1976 federal law that requires herring boats to carry federal observers to collect data used to prevent overfishing. Under a 2020 regulation interpreting the law, owners of the boats were required not only to transport the observers but also to pay $700 a day for their oversight.

Fishermen in New Jersey and Rhode Island sued, saying the 1976 law did not authorize the relevant agency, the National Marine Fisheries Service, to impose the fee.

Two appeals courts — one in Washington, the other in Boston — ruled that the deference called for by the Chevron decision required a ruling for the government. The United States Court of Appeals for the District of Columbia Circuit, in Washington, ruled that the agency’s interpretation of the 1976 law “to allow industry-funded monitoring was reasonable.” The First Circuit, in Boston, said that “at the very least” the agency’s interpretation of the 1976 law was “certainly reasonable.”

The fishermen were represented by Cause of Action Institute , which says its mission is “to limit the power of the administrative state,” and the New Civil Liberties Alliance , which says it aims “to protect constitutional freedoms from violations from the administrative state.” Both groups have financial ties to the network of foundations and advocacy organizations funded by Charles Koch, a billionaire who has long supported conservative and libertarian causes.

Forty years ago, when Chevron was decided by a unanimous but short-handed six-member Supreme Court, with three justices recused, it was generally viewed as a victory for conservatives. In response to a challenge from environmental groups, the justices sustained a Reagan-era interpretation of the Clean Air Act that loosened regulation of emissions, saying the Environmental Protection Agency’s reading of the statute was “a reasonable construction” that was “entitled to deference.”

Chief Justice Roberts noted that the Chevron doctrine has been refined over the years. It has also been, he said, supplemented by the “major questions” doctrine, which says that Congress must be particularly clear when it authorized agencies to interpret laws on significant economic and political matters.

Justice Kagan wrote that there was a theme in the court’s work in this area.

“The majority disdains restraint,” she wrote, “and grasps for power.”
